The full legal terms are below. By registering or continuing to use the Well Kept Realtor Program, you agree to these terms.

1. Acceptance of Terms

By registering for or participating in the Well Kept Realtor Partner Program ("the Program"), you agree to be bound by these Realtor Terms of Service ("Realtor Terms") in addition to the Well Kept general Terms of Service. In the event of any conflict between these Realtor Terms and the general Terms, these Realtor Terms govern with respect to the Program. If you do not agree, you may not participate in the Program.

2. Eligibility Requirements

To participate in the Program, you must at all times:

  • Hold a current, valid, and unrestricted real estate license issued by the appropriate authority in your registered jurisdiction.
  • Be in good standing with your state or provincial real estate commission and any applicable professional associations.
  • Be at least 18 years of age.
  • Provide accurate and truthful information during registration, including your license number, brokerage affiliation, and service area.
  • Promptly notify Well Kept if your license is suspended, revoked, expired, or subject to disciplinary action.

Well Kept reserves the right to verify your license status at any time and to suspend or terminate your account if eligibility requirements are not met.

3. Gift Code Usage Rules

As a verified Realtor Partner, you may generate Well Kept Pro gift codes ("Codes") to give to your clients. The following rules apply to all Codes:

  • Client use only: Codes must be distributed to bona fide current or prospective real estate clients. They may not be used for personal subscriptions, distributed to non-clients, or given to other realtors.
  • No resale: Codes may not be sold, auctioned, bartered, or otherwise exchanged for value.
  • No bulk redistribution: Codes may not be posted publicly (e.g., on social media, coupon sites, or public forums) in a manner that allows unrestricted redemption.
  • One code per client: You should not generate multiple active Codes for the same client unless a prior code has expired or was unused.
  • No manipulation: Generating Codes for fictitious clients, test accounts, or for your own benefit is prohibited and may result in immediate account termination.

Well Kept monitors Code generation and redemption patterns. Abuse of the Code system will result in disciplinary action, including potential legal referral.

4. Honest Representation and Marketing

When promoting Well Kept as part of your real estate business, you agree to:

  • Represent the app's features accurately and only based on information provided by Well Kept.
  • Not claim to be an employee, officer, or official representative of Well Kept.
  • Not imply that Well Kept endorses you personally, your brokerage, or your listings.
  • Not make guarantees about the app's performance, uptime, or future features on behalf of Well Kept.
  • Disclose your role as a "Realtor Partner" rather than misrepresenting the nature of your relationship with Well Kept.
  • Comply with all applicable advertising and disclosure requirements set by your real estate commission or professional association (e.g., REALTOR® Code of Ethics).

5. Client Privacy and Data Responsibilities

When you submit client information (such as name and email address) through your Realtor Dashboard, you represent and warrant that:

  • You have obtained appropriate consent from the client to share their information with Well Kept for the purpose of delivering their gift subscription.
  • The information you provide is accurate and provided with the client's knowledge.
  • You are not submitting information for individuals who have not been your clients in a real estate transaction context.
  • You will not use client information obtained through the Platform for purposes unrelated to your real estate services.

Well Kept's collection and use of client data is governed by our Privacy Policy. You are independently responsible for complying with applicable privacy laws (including CCPA, GDPR, or state equivalents) in your jurisdiction.

6. Prohibited Conduct

In addition to the prohibitions in the general Terms of Service, Realtor Partners specifically may not:

  • Engage in discriminatory practices in the distribution of gift codes or promotion of the Platform, in violation of fair housing laws or any applicable anti-discrimination regulations.
  • Use the Platform to harass, spam, or contact clients who have opted out of communications.
  • Attempt to reverse-engineer, scrape, or extract data from the Platform beyond normal use.
  • Share account credentials or allow another person to operate your Realtor account.
  • Submit false complaints or reports about other realtors or users on the platform.
  • Circumvent suspension or disciplinary action by creating secondary accounts.
  • Use the Program in any way that violates your real estate license obligations, brokerage policies, or applicable law.

7. Compliance Reviews and Disciplinary Actions

Well Kept reserves the right to conduct compliance reviews of any Realtor account at any time. Reviews may be initiated by:

  • A complaint or report submitted by a homeowner or another platform user.
  • Activity that appears inconsistent with your registered service area or real estate license.
  • Irregularities detected through routine account monitoring.
  • A mismatch or concern raised about your licensing status or credentials.
  • An external report or inquiry from a real estate commission or regulatory body.

Depending on the outcome of a review, Well Kept may take the following actions:

  • Official Warning: A formal warning recorded on your account. Your account remains active but further violations may lead to suspension.
  • Temporary Suspension: Account access is restricted for a defined period. Codes cannot be generated and your profile is hidden from homeowners during this time.
  • Indefinite Suspension: Account access is restricted until manually reviewed and reinstated by Well Kept.
  • Permanent Removal: Account is terminated and the email address is barred from future registration in the Realtor Program.

If you believe a compliance action was taken in error, you may contact realtors@wellkept.com to request a review. Well Kept's decisions are final but we are committed to fair and transparent enforcement.

8. Service Area and Jurisdiction

Your Realtor account is tied to the jurisdiction(s) in which you are licensed. You agree to:

  • Only represent clients in jurisdictions where you hold an active, valid license.
  • Update your service area information promptly if your licensing status or territory changes.
  • Not represent yourself as operating in a jurisdiction where you are not licensed.

Well Kept does not verify individual transactions and is not responsible for ensuring that your real estate activities comply with jurisdictional requirements. That responsibility rests solely with you.

9. Program Changes and Termination

Well Kept reserves the right to:

  • Modify, suspend, or discontinue any aspect of the Realtor Program at any time, with or without notice.
  • Change the number of codes you may generate, the duration of gifted subscriptions, or other program benefits.
  • Update these Realtor Terms at any time. Continued participation following notice of changes constitutes acceptance.
  • Terminate your participation in the Program for any violation of these Terms, the general Terms of Service, or applicable law.

Upon termination, any outstanding unredeemed codes associated with your account will remain valid for clients who have already received them, unless the account was terminated due to fraud or abuse.

10. No Guarantees or Warranties

Participation in the Realtor Program does not guarantee homeowner leads, client engagement, referrals, or any business outcome. Well Kept provides the Program "as is" and makes no representations or warranties regarding the commercial value of the Program to your business. The Program is a client value-add tool and not a lead generation service.

11. Indemnification

You agree to indemnify, defend, and hold harmless Well Kept, its officers, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable legal fees) arising from: (a) your participation in the Program; (b) your violation of these Realtor Terms or any applicable law; (c) your real estate activities or representations to clients; or (d) any dispute between you and a client that relates to, or arises from, the gift of a Well Kept subscription.
